These Terms and Conditions ("Terms") govern your use of the Luminance Studio website (luminancestudio.com) and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the service. Luminance Studio, located at 555 Golden Gate Avenue, Suite 200, San Francisco, CA 94102, and reachable at [email protected] or (415) 555-0100, provides professional photography services, including portrait, event, and commercial photography, primarily within the San Francisco Bay Area. These terms are effective as of January 1, 2025.
All prices for photography services are as quoted on our website or in personalized quotes provided to clients. A non-refundable deposit of 50% of the total cost is required to secure your booking. The remaining balance is due upon completion of the photography session or event. We accept payments via credit card (Visa, Mastercard, American Express), PayPal, and bank transfer. Late payments may incur a late fee of 5% per month on the outstanding balance. Luminance Studio reserves the right to withhold final images or prints until full payment is received.
Cancellations made more than 7 days prior to the scheduled photography session will result in forfeiture of the initial deposit. Cancellations made within 7 days of the scheduled session will require payment of the full session fee. Rescheduling is permitted once without penalty, provided it is done more than 7 days prior to the original session date, subject to availability. Luminance Studio reserves the right to cancel a session due to unforeseen circumstances (e.g., illness, equipment failure). In such cases, a full refund of all payments will be issued, or the session will be rescheduled at no additional cost to the client.
Luminance Studio retains all copyright and intellectual property rights to all photographs taken during a photography session. Clients are granted a non-exclusive, non-transferable license to use the photographs for personal use only. Commercial use of the photographs is strictly prohibited without prior written consent from Luminance Studio. Clients may not alter, modify, or reproduce the photographs for commercial purposes without explicit permission. Luminance Studio reserves the right to use the photographs for promotional purposes, including website display, social media marketing, and portfolio showcasing, unless otherwise agreed upon in writing with the client. Any unauthorized use of the photographs may result in legal action.
Luminance Studio provides its services on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the quality, reliability, or suitability of our services. While we strive to deliver high-quality photographs, we cannot guarantee that every photograph will meet the client's exact expectations. We are not responsible for any loss of data or damage to equipment during a photography session, except in cases of gross negligence on our part. Clients are responsible for ensuring the safety and security of their belongings during the session. Luminance Studio is not liable for any indirect, incidental, special, or consequential damages arising out of the use of our services.
In no event shall Luminance Studio, its officers, directors, employees, or agents, be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in any way connected with the use of our services, whether based on contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. Our liability to you for any claim arising out of or relating to our services shall not exceed the total amount paid by you for the services in question. This limitation of liability applies to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
By engaging Luminance Studio's services, clients agree to sign a model release form granting Luminance Studio the right to use their likeness in photographs for promotional purposes. This includes, but is not limited to, use on our website, social media channels, marketing materials, and portfolio displays. Clients who prefer not to have their likeness used for promotional purposes must notify Luminance Studio in writing prior to the photography session. We respect the privacy of our clients and will honor all reasonable requests regarding the use of their images.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in San Francisco, California, and you consent to the jurisdiction of such courts.
Luminance Studio reserves the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any updates or modifications.
